Open Source Software Licensing

In this article we will consider a relatively recent mass licensing phenomenon known as free and/or open source (FOSS) licenses. The article will discuss the history of the open source movement, the most important open source and free software licenses, their differences and similarities and their potential impacts on the licensor and licensee. We will compare them to more traditional licensing forms, in particular traditional mass market licenses, i.e. shrinkwraps, quickwraps and browsewraps. Finally, we will offer guidance for license selection and clearance of third party open source software packages.
